USCIS adjudication depends on numerous factors outside our control, including but not limited to: officer discretion, evidence sufficiency under current USCIS policy, current Visa Bulletin movement, RFEs, and changes in immigration law or guidance. No outcome with USCIS is or can be guaranteed.

You are responsible for the accuracy, truthfulness, and appropriateness of any content you sign, send, submit, or rely upon. The Service is offered under multiple plans, including a monthly Software Portal subscription and one-time Assisted and Premium engagements. Pricing is displayed at eb1apath.com/#pricing and may be updated; the price in effect at the time of your purchase applies to that purchase.
Software Portal subscriptions may be canceled at any time; cancellation stops future renewals but does not refund the current billing period.
For Assisted and Premium engagements: if within 14 days of beginning the engagement we mutually determine that EB-1A is not realistic for your profile, we will refund 50% of fees paid to date. Beyond 14 days or once substantial work has begun, fees are non-refundable except as required by law.

To the maximum extent permitted by applicable law, in no event shall Barmeter Technologies LLC, its officers, members, employees, agents, or contractors be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for lost profits, lost opportunities, business interruption, loss of data, immigration outcomes, denial or delay of any USCIS petition, or any other intangible losses, arising out of or in connection with your use of the Service.
Our aggregate liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed the amount you actually paid to us in the twelve (12) months immediately preceding the claim.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or any warranty of immigration outcome.
You agree to indemnify and hold harmless Barmeter Technologies LLC and its officers, members, employees, agents, and contractors from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) any content you submit to the Service or to a third party (including your attorney or USCIS); (c) your violation of these Terms; or (d) your violation of any law or third-party right.

We may update these Terms from time to time. Material changes will be communicated via email or in-portal notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State in which Barmeter Technologies LLC is registered, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall be resolved by binding arbitration in that State, except that either party may seek injunctive relief in a court of competent jurisdiction.
